Terms of Service - General

(Commission-specific terms are here!)

Requires my consent:

• Using my artwork for manipulation/composite/media (e.g. a youtube video thumbnail, anything that re-contextualizes it, I would just like to be aware in case it has a limited usage agreement already)

• Monetizing my artwork in any way, including but not limited to using it in monetized videos or merchandise (may require compensation).

Does not require my knowledge or consent:

• Using my artwork as your phone, desktop background, or personal social media profile, so long as I am credited in the latter. It's your stuff.

• Reposting/embedding my artwork so long as I am credited by name (Aster Clarke/bioluminosity) and a link to any of my pages is included, such as twitter or artstation.

Forbidden:

• Use of my artwork in blockchain platforms or AI.
• Use of my artwork for promoting goods and use of artwork on any goods (e.g. put on redbubble) outside of my own shops without my knowledge, consent, and/or compensation.

Usage Rights:

• Owners of an IP may approach me for limited/unlimited use of my artworks featuring their IP. I do not claim ownership of said IP (e.g., movie character) and concede to [company]'s terms of use for art reproduction and sale. 

• Artwork that was commissioned privately and features original IP (e.g., the client's character) is not available for use agreement except by the client and me unless otherwise agreed upon with said client. Art featuring [company] IP is subject to company's rules regarding sale of fan products.

• Personal artwork may be available for limited use with permission and/or compensation depending on the usage scenario (merchandise vs. a private project/website/youtube video).

Character Designs/Adoptables:

•  You may post the original design artwork wherever you like, but please credit me for the work I did. I am on toyhou.se as 'bioluminosity'.
• From purchase, the buyer owns the character, but I retain design art copyright for reasonable use (self promo, portfolio uploads, etc.). The design may be altered by the new owner or other individuals so long as original credit is still given.
• You may use your character in personal projects and personal prints/stickers/etc., with full license. Custom designs for commercial projects may require additional terms.
• Artists posting commissions of characters which have been sold do not need to worry about mentioning me, though it is nice.
• I do not refund adopt/character sales. Adopts/characters may be resold within reasonable parameters. They may not be copied and resold en masse.
